The US Department of Education (USDOE) took a different approach to the promulgation of regulations for IDEA 2004 when it decided to work first on the Part B regulations, and then later on tackle Part C. Although proposed Part C regulations ultimately surfaced in May 2007, nary a peep was heard from the USDOE after the conclusion of the comment period. Finally, on September 6, 2011 the USDOE took the unprecedented step of “prepublishing” the final Part C regulations prior to their official publication in the Federal Register. The prepublication was necessary because the final regulations were slated to take effect only 30 days after their official publication in the Federal Register. The Part C regulations were published in the Federal Register on September 28, 2011, making their effective date October 28, 2011.
