The US Department of Education (“USDOE”) has revised its regulations governing the Family Educational Rights and Privacy Act (“FERPA”).  Under the new regulations, the USDOE has made several exceptions to FERPA’s consent rule.  These exceptions include allowing greater access to student educational data for the purposes of research and evaluation purposes and disclosure of directory information.  The new regulations were published in the federal register on December 2, 2011, making their effective date January 2, 2012.  The USDOE plans to host a series of FERPA webinars regarding the new regulations.  The first two webinars are scheduled for December 7, 2011 at 2:00 p.m. and January 11, 2012 at 2:00 p.m.  The USDOE anticipates holding a webinar for FERPA in the context of special education in February or March of next year.
