In a recently issued letter, the Office of Special Education Programs (“OSEP”), clarified that a bus suspension would count as a day of removal if transportation is included as a related service in the IEP regardless of whether the student attended school unless the district makes alternative arrangements to get the student to school.  Traditionally, in situations where a student is suspended from the bus, the parent either voluntarily transports the student or makes other arrangements for the student to get to school.  According to OSEP, because it is the parent and not the district that has arranged for alternative transportation to school, the district must count the student’s bus suspension as a day of removal.  This is a change from previous guidance issued by OSEP.
