Today, the United States Department of Education published final regulations amending Title I and the IDEA that eliminate the 2% rule that allows states to develop alternate assessments that are aligned to modified academic achievement standards for students with disabilities.  Under the new regulations, which take effect on September 21, 2015, with the exception of students with the most significant disabilities, students with disabilities can no longer be assessed using alternative assessments based on modified academic achievement standards for Elementary and Secondary Education Act (“ESEA”) accountability purposes.
